Motion made by Selectman Cahalane to approve the Regular and Executive Session minutes of Monday, May 24, 2010 as presented.

COMMUNICATIONS AND CORRESPONDENCE:
Sample Postcard for Approval – Town Conversion of Private Roads:
In response to the Selectmen’s request to schedule a public forum on the conversion of the following roads; Timberland Shores, Algonquin Avenue and Cape Drive to public ways, the Director of Public Works has scheduled a proposed notice in the form of a sample postcard for the Selectmen’s review and approval.
Catherine Laurent, the DPW Director was in attendance to discuss the public forum and its format scheduled for June 28, 2010 at 6:30 p.m. at the Mashpee Senior Center. In addition to the Director of Public Works, the Town Manager and Police and Fire Chief will be present for comment. The Board of Selectmen will post the meeting to allow attendance for a full member quorum.
The notice states:
Your Input is Requested
Should the Town of Mashpee take your road?
The Town is considering converting your road from a private road to a Town road. You are invited to attend a public forum to discuss this question.

It was agreed the notice would be forwarded to all affected property owners and will be advertised in the Mashpee Enterprise and on the Town’s website. The notice will also be posted at Town Hall.
Motion made by Selectman Taylor to approve the Sample Postcard on the proposed conversion of certain private roads as presented to include the cost of postage.

COMMUNICATIONS AND CORRESPONDENCE:
Library - Temporary Closure:
As a result of an unusual odor, the new Mashpee Library was temporarily closed last week and the library staff was relocated to Town Hall. It was announced the Barnstable County Board of Health conducted an assessment, and there are no pending air quality issues. The matter is under continued review. The Town Manager indicated that a more definitive update will be obtained later this week.
Recycling Update:
With regards to the importance of recycling, the Recycling Committee is continuing their efforts to educate the public through the cable television government channel, via DVD and by way of brochures to be distributed at the Transfer Station.
Town Audit Report:
A joint meeting is forthcoming with the Finance Committee to review the exit interview with the Town’s auditing firm. The Selectmen have briefly reviewed the report and expressed appreciation to the Town Manager and to the Accounting Department for conducting due diligence to correct past issues that were previously identified in the audit process.

Review of Constable Application:
The Selectmen were in receipt of an application from Scott E. Thompson, a Mashpee resident requesting appointment as Constable. All necessary paperwork was in order for the Selectmen’s approval.
Motion made by Selectman Cahalane to appoint Scott E. Thompson as a Constable in the Town of Mashpee.

Acceptance of Resignation – Planning Board Associate Member:
Correspondence was received from John Cotton dated May 18, 2010 resigning from his position as an associate member to the Planning Board. Additional information was received from the Planning Board relative to the replacement of Mr. Cotton by a joint vote of the majority of the combined Board of Selectmen and Planning Board.
Motion made by Selectman Richardson to accept the resignation of John Cotton as an Associate Member of the Planning Board with regrets.

It was agreed the above referenced position would be duly advertised, and then scheduled at a future date for a joint appointment.
APPOINTMENTS AND HEARINGS:
Public Hearing – Private to Public Road Conversion – Bayshore Drive/Brookside Circle:
The Board of Selectmen opened the Public Hearing on the private to public road conversion of the following roads; Bayshore Drive and Brookside Circle as shown on plans entitled Easement Taking and Layout Plan of Bayshore Drive and Easement Taking and Layout Plan of Brookside Circle dated January 25, 2010. Copies of the plans may be reviewed in the Office of the Board of Selectmen at Mashpee Town Hall.
Catherine Laurent, the Director of Public Works was in attendance to review matters pertaining to the roadway acceptance. The estimated cost of the roadways is $129,837.54. The maximum betterment cost to be borne by 51 property owners is $2,545.83. It was noted that all property owners have received notification of the proposed betterment. It was disclosed the cost may be paid at the time of billing or spread over a twenty year payment period.
The Hearing was opened to solicit comment.
Peter Squeglia of 44 Bayshore Drive asked why it is necessary to completely replace the entire street. Mr. Squeglia indicated the bulk of the expenses are related to leveler and concrete.
In response the DPW Director indicated the road is approximately 30 years old. It is the intention of the betterment to replace 2” of existing asphalt to protect the Town from future repair costs for an estimated ten years. Ms. Laurent indicated there has been a reoccurrence of road cracking. It was noted the Water District installed an overlay in 2002. And, in an eight year period, the road cracks have re-appeared a number of times. The new road as proposed will meet Town road standards.
Jack Walsh, 47 Bayshore Drive stated that he has been a resident for the past ten years. In his opinion, the cracks may be caused by the installation of cable as they appear to be at a set spacing in the road. It was agreed at that time, it was a former matter associated with the cable provider under contract with the homeowners association.
It was agreed that Bayshore Drive is in need of leveler course however, it was not clear if Brookside Circle is in need of this repair. This matter will be reviewed by the DPW Director. It was noted the Town reviews all cost assumptions to minimize the betterment costs to the homeowner.
Herb Bearak of 14 Bayshore Drive a resident since 1991 indicted he hired a local contractor to pave his driveway at the time of the Water District installation. Presently, his driveway has cracking at the bottom of the drive where it connects to the street. In his opinion, the street appears to look fine, but there are visible cracks and drainage issues. Mr. Bearak recommended the Town take over the entire street, complete what is necessary, and each resident should be responsible for the expense as it relates to the general area.
Being no further comment, the Selectmen motioned to close the hearing.
Motion made by Selectman Taylor to close the Public Hearing.

It was disclosed this is the first phase of a two-phase petition process. After the hearing, if the abutters choose to move forward, a second petition must be submitted to the Selectmen’s Office to allow the matter to be placed on a future Town Meeting warrant.

Recommendation for Appointment – Historic District Commission:
Correspondence was received from the Planning Board dated May 20, 2010 recommending the appointment of two members as per Town Bylaw, for possible appointment to the Historic District Commission. Dennis Balzarini has expressed a willingness to serve and Joseph E. Mullin has also expressed his willingness to serve. However, Mr. Mullin’s work schedule limits his ability to serve.
Motion made by Selectman Taylor to appoint Dennis Balzarini to the Historic District Commission.

Recommendation for Appointment – Planning Board Representative to the EOC:
In other matters, Mary E. Waygan was recommended by the Planning Board to continue as the Planning Board representative to the Environmental Oversight Committee. There was no action, as Ms. Waygan is on the annual reappointment list, and the Board is expected to take action on the reappointment list at their next meeting.
NEW BUSINESS:
Appointment of Mashpee’s Representative to the Ocean Management Planning DCPC:
The Cape Cod Commission remitted communication to the Selectmen dated May 20, 2010 requesting an appointment of a Town representative to serve on the Ocean Management Planning DCPC. The policy committee will oversee the DCPC planning process and technical working groups. The Ocean Management Plan DCPC addresses development of the Cape’s ocean waters for renewable energy and other uses allowed by the state’s Ocean Management Plan. The kick-off meeting is scheduled for July 13, 2010 at the Commission’s office in Barnstable.
Motion made by Selectman Taylor to appoint Selectman Michael Richardson to the Ocean Management Planning DCPC.
Motion seconded by Selectman Sherman.

NEW BUSINESS:
Request for Approval of Change Order #8 – Mashpee Public Library:
The Planning & Construction Committee voted to recommend the Selectmen approve Change Order #8 associated to the Mashpee Public Library in the amount of $9,014. The change order is relative to matters pertaining to the projector, elevator core revision, miscellaneous electrical issues, the ceiling in the solar room and maple panes at the stairs. It was noted that some of the change orders are related to code issues, and design flaws. To date, the total change orders amount to approximately $120,000.
Motion made by Selectman Cahalane to approve the Mashpee Public Library Change Order #8 as referenced.

Review & Execution of Mashpee Landfill Monitoring Contract For FY2011:
Correspondence was received from Glen Harrington; the Board of Health Agent dated June 1, 2010 relative to the Landfill Monitoring contract for FY2011. The information was deemed incomplete. The Selectmen agreed to defer the matter to the next scheduled meeting.
LIAISON REPORTS:
Mashpee Public Schools:
The annual Special Olympics; referenced as the Cape Cod School Day Games was held in Mashpee on May 28, 2010 during normal school hours. It was reported the event was very successful and enjoyed by all participants and observers.
The Mashpee High School graduation is scheduled for Saturday, June 12, 2010 at 10:00 a.m.
LIAISION REPORTS:
South Cape Beach Advisory Committee:
Due to quorum problems, the SCBAC is considering reducing its nine member committee membership.

The Board will enter into Executive Session at this time for the purpose of discussing collective bargaining. The Board will not reconvene in Open Session.
